Amendment of law 50/1991 regarding the authorization of the works for closing the balconies

Law no. 149/2020 for the amendment and completion of law no. 50/1991 on the authorization of the execution of construction works.
In force from 27 July 2020, it shall be amended and supplemented as follows:
1. In Article 7, the following is inserted after paragraph 20:
With the agreement of the owners' association, works can be carried out to close the balconies / loggias located on the ground floor of the multi-storey residential buildings if the changes to the construction are made for safety reasons, mitigation of emissions, noise, garbage and safety and health to those living in that apartment.
2. In Annex 1, Chapter I, Section 1, point 2.5.6 is amended to read as follows:
The agreement of the owners' association according to the legal provisions in force, expressed in authentic form, for new constructions, located adjacent to existing constructions or in their immediate vicinity - and only if intervention measures are necessary to protect them -, for construction works necessary to change the destination in existing buildings, as well as in the case of the construction of buildings with a destination other than that of the neighboring buildings.
3. In point 2 of Annex 2, a new subparagraph shall be inserted after point 2 with the following content:
Owners' associations, which hold titles to land around condominiums, may enter into leases, leases, uses or concessions on them, as well as on land belonging to the condominium with interested owners, to expand the spaces on the ground floor, with the agreement of the general meeting expressed by a decision adopted with 2/3 of the total number of owners and the agreement expressed in writing of all the owners directly affected.
